The obligation to ensure road safety stipulates that the owner of a property is responsible for ensuring that no one is harmed on the property. A landlord’s duty to ensure safety includes not only the apartment and other rooms (cellar, garage, etc.), but also the entrances, stairways, gardens and other facilities that can be used by the community. A breach of this duty can quickly become expensive for those responsible.
Common tasks include removing leaves from sidewalks in the fall or clearing and gritting snow and ice in the winter. Furthermore, regular checks should be made to ensure that there are no loose elements on the facade of the house or on the roof (e.g. loose bricks). In addition, trees (tree inspections) and staircases, among other things, should be inspected regularly.
